UBLIC CONTRACT
for the Provision of Medical Services

This public contract (hereinafter referred to as the “Contract”) is an official public offer from the Limited Liability Company “Phlebology and Aesthetic Medicine Medical Center ‘Phlebos’” (hereinafter referred to as the “Provider”) addressed to any natural person (hereinafter referred to as the “Patient”) for concluding a contract under the terms described below.

1. General Provisions

1.1. This Contract is concluded in accordance with Articles 633, 634, 641, and 642 of the Civil Code of Ukraine and is equivalent to a contract signed by the parties.

1.2. The acceptance of this Contract shall be deemed any action indicating acceptance of its terms, including but not limited to:

  • scheduling an appointment;
  • signing an informed consent form;
  • seeking medical services in fact;
  • making payment.

2. Subject of the Contract

2.1. The Provider undertakes to deliver medical services, the scope and list of which shall be agreed with the Patient, in accordance with the approved tariffs and medical standards, while the Patient undertakes to pay for the services rendered in accordance with current tariffs.

3. Rights and Obligations of the Parties

The Provider undertakes to:

  • provide medical services in accordance with the laws of Ukraine;
  • maintain medical confidentiality;
  • provide complete information about the Patient’s health and the scope of medical intervention.

The Patient undertakes to:

  • provide complete and accurate information about their health condition;
  • sign informed consent for medical intervention;
  • follow medical recommendations;
  • pay for the medical services according to the issued invoice and within the agreed timeframe.

4. Informed Consent

4.1. Before receiving medical services, the Patient shall sign an informed consent form outlining the nature and purpose of the procedure, potential risks, complications, treatment alternatives, and shall have the opportunity to ask questions.

4.2. Without signed informed consent, the Provider has the right to refuse service.

5. Service Provision Procedure

5.1. Services are provided by prior appointment or according to the Provider’s working schedule.

5.2. Payments are made before or after the service is provided, in cash or via non-cash methods.

5.3. Service costs are defined according to the current price list published on the website or available on the Provider’s premises.

6. Service Costs and Payment Procedure

6.1. Payment is made in accordance with current tariffs, either before or after the service is rendered (depending on the type of service).

6.2. The Provider reserves the right to unilaterally change the prices for services upon publication of the new rates.

7. Service Cancellation or Rescheduling

7.1. The Patient has the right to cancel or reschedule a planned service no later than two hours before the scheduled time.

7.2. If the service cannot be provided due to the Provider’s fault, the payment shall be refunded in full or rescheduled at the Patient’s request.

8. Liability of the Parties

8.1. The Parties shall be liable for failure to fulfill or improper fulfillment of obligations under the applicable laws of Ukraine.

8.2. The Provider shall not be liable for negative consequences arising from:

  • concealment or provision of false health information by the Patient;
  • failure to comply with the recommendations of medical professionals.

9. Force Majeure

9.1. The Parties shall be released from liability for partial or complete failure to fulfill obligations if this is due to force majeure circumstances properly confirmed.

10. Dispute Resolution

10.1. All disputes arising between the Parties shall be resolved through negotiations.

10.2. If an agreement cannot be reached, disputes shall be resolved under the laws of Ukraine.

11. Personal Data Processing

11.1. The Patient consents to the processing of their personal data for the execution of this Contract in accordance with the Law of Ukraine “On Personal Data Protection.”

11.2. The data is processed solely for the purpose of fulfilling this Contract and is not shared with third parties without the Patient’s written consent, unless required by law.

12. Term of the Contract

12.1. This Contract becomes effective upon acceptance (appointment, inquiry, or payment) and remains in force until the Parties fully fulfill their obligations.

12.2. The Contract is open-ended and remains valid in its current version published on the Provider’s website.
